Controversial ‘racist’ Eminem recordings will be made available, a judge has ruled.

Hip-hop magazine The Source had sought to publish material from two tracks the rapper recorded as a teenager, which it maintains are racist.

Eminem’s lawyers had argued that publishing the tracks would violate copyright laws. However, in New York on December 22, District Judge Gerald E Lynch ruled that limited reproduction constituted “fair use” of copyrighted material for the purposes of criticism, according to the BBC. The magazine will be allowed to publish 20 seconds and eight lines from the songs.

The Source magazine will now be allowed to publish CDs featuring up to 20 seconds of two previously unreleased works the rapper recorded as a teenager.

Eminem has apologised for the lyrics, which contain the lines “black girls are dumb”, stating he made the track “out of anger, stupidity and frustration” after splitting up with a black girlfriend.

Last month The Source accused Eminem of racism at a press conference to announce its unearthing of the tracks.
